1. Acceptance of Terms

By accessing or using Cliply AI Video Generator ("Cliply," "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Eligibility

You must be at least 13 years old to use Cliply. By using the Service, you represent that you are at least 13 years of age. If you are under 18, you must have parental or guardian consent. We reserve the right to terminate accounts of users who misrepresent their age.

3. Use of the Service

3.1 Permitted Use

You may use Cliply to:

• Generate AI videos and images for personal or commercial use
• Browse and use templates from our library
• Download and share content you create (subject to content restrictions below)

3.2 Prohibited Content

You may NOT use Cliply to generate:

• Pornographic, sexually explicit, or adult content
• Content depicting minors in a sexual manner (zero tolerance — will result in immediate termination and reporting to authorities)
• Graphic violence, gore, or content promoting self-harm
• Hate speech, content targeting protected characteristics
• Deepfakes of real people without their explicit consent
• Content that infringes on third-party intellectual property rights
• Illegal content of any kind
• Content intended to harass, bully, or defame individuals

3.3 Prohibited Activities

• Attempting to circumvent credit limits or access controls
• Scraping, crawling, or automated access without written permission
• Reverse engineering the Service or API
• Sharing account credentials with others
• Using the Service for any illegal purpose

4. Credits and Subscriptions

4.1 Credits

Video generation requires credits. New users receive a starter credit balance upon registration. Additional credits may be purchased through our in-app credit packs. Credits do not expire and are non-refundable unless required by law.

4.2 Credit Costs

• Text to Video (5s): 5 credits
• Text to Video (10s): 7 credits
• Text to Video (15s): 9 credits
• Image to Video (480p/5s): 5 credits
• Image to Video (720p/7s): 12 credits

4.3 Subscriptions

We offer subscription plans that provide monthly credit allocations. Subscriptions auto-renew unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period. Refunds for subscription fees are not provided except where required by law.

4.4 Refund Policy

Credits consumed for successful generations are non-refundable. If a generation fails due to a server error on our side, credits will be automatically refunded to your account.

5. Intellectual Property

5.1 Your Content

You retain ownership of content you upload (images, prompts). By using the Service, you grant Cliply a non-exclusive, worldwide, royalty-free license to process your content solely for the purpose of providing the Service.

5.2 Generated Content

AI-generated videos and images created using the Service are owned by you, subject to these Terms. You are responsible for ensuring your use of generated content complies with applicable laws and does not infringe third-party rights.

5.3 Cliply Property

The Cliply platform, logo, codebase, templates, and all related intellectual property are owned by Cliply. You may not copy, modify, or distribute our proprietary materials without written permission.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Cliply and its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Unused credits may be forfeited upon termination due to Terms violations.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting a notice on the Service. Your continued use of Cliply after changes take effect constitutes your acceptance of the revised Terms.
